What the Authority decided

On 9 September 2026, the Office of the Migration Agents Registration Authority (the Authority) decided to cancel the registration of Mr Mohammed Ismail Saud, (MARN 1909826) following an investigation into the Agent’s conduct.

The Agent must not be registered for a period of five years from the date of the decision.

The Authority was satisfied that the Agent breached his obligations under clauses 2.1, 2.1A(d), 2.9, 8.1, 8.2 and 8.3 of the former Code of Conduct for Registered Migration Agents (the former Code) and sections 13, 15, 17, 18(1)(a), 18(1)(b), 20, 23, 24, 34, 49, 55 and 56 of the Migration (Migration Agents Code of Conduct Code) Regulations 2021 (the Code).

The Authority found that the Agent:

  • Failed to act in accordance with the law, specifically section 312A of the Act, by failing to declare to the Department the immigration assistance he provided to clients.
  • Made false and misleading statements in support of applications and to the Department, which he knew to be false and misleading.
  • Failed to maintain proper client records, and give service agreements, invoices and receipts to his clients.
  • Failed to act professionally, competently, diligently, ethically and honestly with integrity.
  • Failed to inform his clients of conflicts of interest and commission payments received by way of referrals to the education provider where his spouse was director.
  • Failed to provide proper supervision of his staff and facilitated members of his business to provide unlawful immigration assistance.
  • Failed in his duties in relation to work or services performed by persons other than RMAs.
  • Acted in a way that was intended to undermine the purpose and intent of the student visa program and the migration law to obtain a benefit for himself and his clients.

The Authority was also satisfied that the Agent was not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.

The registration is removed. The agent's name comes off the Register of Migration Agents and they may not give immigration assistance. A cancellation is usually accompanied by a period during which the person may not be registered again.

  6. Only then, find someone else. A new agent needs the file and the dates. The first five steps are what make that first conversation useful instead of exploratory.

What this decision does not mean

It is a decision about one individual on one date. Only a person can be a registered migration agent — a company cannot — so it says nothing about anyone else at the same practice. Decisions of this kind are reviewable, and bars and suspensions expire. The register is where the current position lives.
